This Skincare Disclaimer and Product Use Policy (“Policy”) forms an integral part of the Terms and Conditions governing the use of the Bingsu Platform. By accessing, purchasing, or using any products available on the Platform, you acknowledge that you have read, understood, and agreed to be bound by this Policy.
Skincare Disclaimer & Product Use Policy
1.1 Nature of Products
All products made available on the Platform are cosmetic products intended solely for external use on the skin, face, or body. Such products are not pharmaceutical products, medical devices, or prescription treatments.
Nothing on the Platform, including product descriptions, marketing materials, or customer testimonials, shall be construed as medical advice or as a claim that any product is intended to diagnose, treat, cure, or prevent any disease or medical condition.
1.2 Patch Test Requirement
Users are strongly advised to conduct a patch test prior to the first use of any product, particularly in cases of sensitive, reactive, or allergy-prone skin.
A patch test should be performed by applying a small quantity of the product to a discreet area of the skin and observing for any adverse reaction over a period of 24–48 hours.
Failure to conduct a patch test may increase the risk of adverse reactions. To the fullest extent permitted by applicable law, Bingsu shall not be liable for any skin irritation, allergy, or adverse reaction resulting from the use of products without prior patch testing.
1.3 Individual Results Disclaimer
Results from the use of skincare products may vary between individuals. Outcomes depend on multiple factors including, but not limited to, skin type, age, genetics, pre-existing conditions, environmental factors, and consistency of product use.
Any representations of results on the Platform are illustrative in nature and do not constitute a guarantee of specific outcomes.
1.4 Medical Disclaimer
The products offered on the Platform are not intended to substitute professional medical advice, diagnosis, or treatment.
Users are advised to consult a qualified dermatologist or healthcare professional prior to using any product if they:
(a) have a pre-existing or diagnosed skin condition;
(b) are undergoing dermatological or medical treatment;
(c) are using prescription-based topical or oral medications; or
(d) are pregnant, nursing, or have any underlying medical condition.
Bingsu expressly disclaims any liability arising from the use of products in conjunction with medical treatments or in circumstances requiring professional supervision.
1.5 Ingredient Sensitivities & Allergies
Ingredient lists (INCI) for all products are made available on the respective product pages on the Platform. Users are responsible for reviewing such ingredient information prior to purchase and use.
Certain ingredients, including but not limited to fragrances, essential oils, alcohols, retinoids, AHAs, BHAs, vitamin C derivatives, and preservatives, may cause sensitivity or allergic reactions in some individuals.
To the fullest extent permitted by applicable law, Bingsu shall not be liable for any adverse reactions arising from the use of products where full ingredient disclosure was made available at the time of purchase.
1.6 Proper Use of Products
All products must be used strictly in accordance with the instructions provided on the packaging and/or on the Platform.
Without prejudice to the generality of the above:
(a) Sunscreens require periodic reapplication and do not provide continuous protection from a single use;
(b) Exfoliating and active-based products must not be used in excess of recommended frequency;
(c) Active ingredients should be introduced gradually into a skincare regimen; and
(d) Products are for external use only unless expressly stated otherwise.
Bingsu shall not be liable for any adverse effects resulting from misuse, overuse, or use inconsistent with product instructions.
1.7 Product Sourcing & Regulatory Compliance
Bingsu sources its products from authorised distributors, brand partners, and verified import channels. Reasonable measures are undertaken to ensure that products offered are genuine and suitable for cosmetic use at the time of dispatch.
All products are handled and distributed in compliance with applicable Indian laws, including the Drugs and Cosmetics Act, 1940, and applicable rules and guidelines issued by relevant regulatory authorities, including the Central Drugs Standard Control Organisation (CDSCO), where applicable.
1.8 Storage, Handling & Shelf Life
Users are responsible for the proper storage and handling of products after delivery.
Products should be stored in accordance with the instructions provided on the packaging. Improper storage, including exposure to heat, sunlight, or air, may affect product stability and effectiveness.
Users are advised to:
(a) store products in a cool, dry place;
(b) keep containers securely closed after use;
(c) follow the Period After Opening (PAO) guidelines; and
(d) discontinue use if any change in colour, texture, or odour is observed.
Bingsu shall not be liable for any degradation in product quality resulting from improper storage or handling after delivery.
1.9 Limitation of Liability
To the fullest extent permitted by applicable law, Bingsu, its affiliates, and its partners shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use or misuse of any product purchased from the Platform.
Use of all products is at the sole discretion and risk of the user.
