1.1 About Us
Bingsu is a Korean skincare brandoperatedand managed fromAhmedabad,Gujarat,India.Our Platform offers curated Korean skincare products for consumers.The Platform is hosted at www.bingsu.skin and all transactions are processed in Indian Rupees (INR).
1.2 Acceptance of Terms
By visiting, browsing, registering, or placing an order on our Platform, you unconditionally accept and agree to be bound by these Terms, along with our Privacy Policy, Shipping Policy, Return & Refund Policy, Cancellation Policy, and Skincare Disclaimer (collectively referred to as the "Policies"). These Policies together form a binding legal agreement between you ("User", "Customer", "you") and Bingsu.
If you are accessing the Platform on behalf of a company, organisation, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.
1.3 Eligibility
Use of the Platform is restricted to individuals who are 18 years of age and above. By using the Platform, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872.
Minors under the age of 18 may only access the Platform under the direct supervision of a parent or legal guardian who assumes full responsibility for any activity, purchase, or use made under their supervision. Bingsu does not knowingly collect personal information from minors.
1.4 User Account
Certain features of the Platform, including order placement, may require you to register for an account. When creating an account, you agree to:
- Provide accurate, current, and complete information as prompted by the registration form
- Maintain and update your account information to keep it accurate and current
- Keep your login credentials (username and password) confidential and not share them with any third party
- Be solely responsible for all activity that occurs under your account
- Notify us immediately at info@bingsu.skin if you suspect any unauthorised access to or use of your account
Bingsu reserves the right to suspend, deactivate, or permanently delete any account that violates these Terms or is found to be fraudulent, without prior notice and without liability.
1.5 Products & Services
Bingsu offers Korean skincare products including but not limited to cleansers, toners, serums, moisturisers, sunscreens, face masks, eye creams, and body care products. All products are sourced from authorised distributors and are guaranteed to be 100% authentic.
While we strive to ensure that product descriptions, images, and pricing are accurate, we do not warrant that all content on the Platform is error-free, complete, or current. Bingsu reserves the right to modify product information, pricing, and availability at any time without prior notice.
Products listed on the Platform are intended for lawful use within India only, unless otherwise expressly stated. We currently do not offer international shipping. Users are responsible for ensuring that their purchase and use of products comply with all applicable local laws and regulations.
1.6 Product Descriptions & Accuracy
Bingsu makes reasonable efforts to ensure that product descriptions, ingredient lists, images, and pricing are accurate and up to date. However, we do not represent or warrant that all content on the Platform, including product descriptions, colours, sizes, or other details, are entirely accurate, complete, reliable, current, or error-free.
Product images are provided for illustrative purposes only. Actual product appearance, colour, shade, or packaging may vary due to lighting conditions, device display settings, or manufacturer changes. Such variations shall not be considered defects, and Bingsu shall not be liable for the same.
We reserve the right to correct any errors, inaccuracies, or omissions, and to update or modify product information, pricing, or availability at any time without prior notice.
1.7 Pricing & Taxes
All prices displayed on the Platform are in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST), unless stated otherwise. Any applicable shipping or handling charges will be displayed separately at checkout prior to order confirmation.
Bingsu reserves the right to change product prices at any time without prior notice. In the event of a pricing or typographical error, Bingsu reserves the right to cancel or refuse any order placed at an incorrect price, whether or not the order has been confirmed.
Prices applicable to an order shall be those in effect at the time of order placement, subject to acceptance by Bingsu.
1.8 Order Placement & Acceptance
Placing an order on the Platform constitutes an offer by you to purchase the selected products subject to these Terms. An order shall be deemed accepted only when Bingsu issues an Order Confirmation via email or other communication confirming dispatch of the product(s).
Bingsu reserves the right to accept, reject, or cancel any order, in whole or in part, at its sole discretion, including but not limited to the following circumstances:
- Product unavailability or stock limitations
- Errors in pricing, product information, or listings
- Suspected fraudulent or unauthorised transactions
- Payment failure or verification issues
- Inability to deliver to the specified address
In the event an order is cancelled after payment has been successfully processed, a refund shall be initiated to the original payment method within 7–10 business days, subject to the policies of the payment provider.
1.9 Payment
Bingsu accepts payments through authorised third-party payment gateway providers, including CCAvenue in association with Kotak Mahindra Bank. Accepted payment methods may include:
- Credit Cards (Visa, Mastercard, American Express, RuPay)
- Debit Cards
- Net Banking
- UPI (Unified Payments Interface)
- Mobile Wallets (as supported by the payment gateway)
All payment transactions are processed through secure and encrypted channels. Bingsu does not store or process your card or banking details directly. All payment information is handled by third-party payment service providers in accordance with their respective privacy and security policies.
Bingsu shall not be liable for any payment failures, transaction errors, or unauthorised transactions arising due to issues with the payment gateway, banking systems, or user negligence
1.10 Intellectual Property
All content on the Bingsu Platform — including but not limited to the brand name, logo, taglines, product names, product images, website design, graphics, text, user interface, and all other materials — is the exclusive intellectual property of Bingsu and/or its licensors and is protected under applicable Indian intellectual property laws, including the Trade Marks Act, 1999 and the Copyright Act, 1957.
Nothing in these Terms shall be construed as granting, by implication or otherwise, any license or right to use any intellectual property without prior written consent from Bingsu.
You are strictly prohibited from:
- Reproducing, copying, distributing, or commercially exploiting any content from the Platform without prior written consent
- Using Bingsu’s brand name, logo, or trademarks in any manner without authorisation
- Scraping, crawling, or extracting data from the Platform using automated or manual means
Bingsu reserves the right to take appropriate legal action for any violation of its intellectual property rights.
1.11 Prohibited Conduct
You agree not to use the Platform for any of the following purposes:
- Engaging in any unlawful, fraudulent, or deceptive activity
- Posting or transmitting any harmful, offensive, defamatory, obscene, or otherwise objectionable content
- Attempting to gain unauthorised access to any portion of the Platform, accounts, or backend systems
- Interfering with or disrupting the integrity, performance, or security of the Platform
- Reselling products purchased from the Platform without prior written consent from Bingsu (applicable to B2C users; B2B resellers must operate under a separate agreement)
- Impersonating any person or entity or misrepresenting your affiliation
Bingsu reserves the right to suspend or terminate access to the Platform for any violation of the above.
1.12 Third-Party Links
The Platform may contain links to third-party websites, social media platforms, or external resources for user convenience. Bingsu does not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third-party websites.
Accessing such third-party links is at your own risk, and you are advised to review their respective terms and policies before engaging with them.
1.13 Disclaimer of Warranties
The Platform and all products and services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.
To the fullest extent permitted by law, Bingsu disclaims all warranties, including but not limited to:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or reliability of content
Bingsu does not warrant that:
- The Platform will be uninterrupted, secure, or error-free
- Defects will be corrected
- The Platform or servers are free of viruses or harmful components
1.14 Limitation of Liability
To the fullest extent permitted under applicable law, Bingsu and its directors, employees, partners, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising out of or in connection with:
- Use or inability to use the Platform
- Purchase or use of products
- Any unauthorised access to or use of user data
- Any third-party conduct or content
In all circumstances, Bingsu’s total aggregate liability arising out of or relating to any specific order shall not exceed the amount actually paid by you for that order.
1.15 Indemnification
You agree to indemnify, defend, and hold harmless Bingsu and its directors, officers, employees, affiliates, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use or misuse of the Platform
- Your violation of these Terms
- Your violation of any applicable law or third-party rights
1.16 Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India.
Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Ahmedabad, Gujarat, India.
1.17 Amendments to Terms
Bingsu reserves the right to amend, modify, or update these Terms at any time at its sole discretion. Updated Terms will be posted on the Platform with a revised effective date.
Your continued use of the Platform following such updates constitutes your acceptance of the revised Terms.
1.18 Severability
If any provision of these Terms is held to be invalid, unlawful, or unenforceable, such provision shall bemodifiedto the extent necessary to make it enforceable or, if not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.
1.19 Entire Agreement
These Terms, along with the Privacy Policy, Shipping Policy, Return & Refund Policy, Cancellation PolicyandSkincare Disclaimer,constitute the entire agreement between youand Bingsu and supersede all prior communications, understandings, or agreements relating to the subject matterherein.
All policy documents are subject to the laws of India and jurisdiction of courts in Ahmedabad, Gujarat.
